Man alleges Plantation Kentucky Fried Chicken restaurant restricts access to disabled

FORT LAUDERDALE – A disabled Miami-Dade County man alleges a Plantation restaurant has barriers that restricted his access to its facilities.

Doug Longhini filed a complaint on May 4 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against SBKFC Holding LLC and KFC Corp. alleging that the restaurant operators failed to uphold Americans with Disabilities Act regulations.

According to the complaint, the plaintiff alleges that in April, he visited the defendants' facilities in Plantation to conduct business, purchase and eat food but he encountered architectural barriers to access their facilities. He alleges he was not able to access the parking lot, main entrance and public restrooms. The plaintiff holds SBKFC Holding LLC and KFC Corp. responsible because the defendants allegedly failed to remove from their facilities architectural barriers to the extent readily achievable and failed ensure to the maximum extent feasible, the altered portions of the facilities were readily accessible to and useable by individuals with disabilities.

The plaintiff requests a trial by jury and seeks permanent injunction enjoining defendants from continuing their discriminatory practices, ordering defendants to alter the subject premises to comply with the ADA and ADA Accessibility Guidelines, ordering defendants to maintain accessible features at the subject premises, awarding reasonable attorneys’ fees and costs, closing the subject premises until the requisite modifications are completed and for such further relief that the court deems just and proper. He is represented by Rafael Viego III and Mario E. Lopez of Federal Disability Advocates in Miami.
