Disabled woman accuses Aetna Life Insurance Co. of wrongful termination of benefits

ORLANDO – A former Burns & McDonnell Engineering Co. employee alleges that her disability benefits were wrongfully terminated.

Tamara Craig filed a complaint on April 25 in the U.S. District Court for the Middle District of Florida, Orlando Division against Aetna Life Insurance Co. alleging that the claims administrator allegedly violated the Employee Retirement income Security Act.

According to the complaint, the plaintiff alleges that beginning in July 2015, she has not received her benefits under the long-term disability plan after having previously received them since June 2012. As a direct result, she alleges she has suffered damages for loss of benefits. The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly denied her appeal for long-term disability benefits and group life waiver of premium benefits, disregarded medical evidence favoring disability and instead relied on the views of its own medical consultants, and breached the terms of the life insurance policy.

The plaintiff requests a trial by jury and seeks reinstatement to group life waiver of premium benefits, compensation for unpaid benefits, plus interest, attorney's fees and costs and for such further relief as the court may deem just and proper. She is represented by Edward P. Dabdoub and Geannina Burgos of Wagar Dabdoub PA in Miami.
