Man alleges GB Instruments used unlawful employment practices

MIAMI – A former production superintendent is suing his Deerfield Beach employer alleging he was not paid overtime and detained in Russia on a trip because of the employer's unlawful practices.

Avraham Dadon filed a complaint on April 21 in the U.S. District Court for the Southern District of Florida against GB Instruments Inc., doing business as GBI Data & Sorting Systems and also known as GBI Intralogistics Solutions, alleging that the former employer violated the Fair Labor Standards Act and the Florida Whistleblower Act.

According to the complaint, the plaintiff alleges that in late October 2014, he was sent Moscow, Russia on a tourist visa to work on a machine purchased by the defendant's client, which and required him to overstay the time allowed on the visa. As a result, the suit states that he was detained in Russia for not complying with immigration law. In December 2014, shortly after his return to work in Florida, the suit states he objected to and refused to continue participating in defendant's unlawful practice of traveling out of the country on a tourist visa. As a result, he alleges the defendant began subjecting him to disparate treatment in December 2014, continuing through his termination on April 15, 2015.

He also alleges he regularly worked for more than 40 hours per week without proper compensation. He claims he has suffered and continues to suffer lost earnings, emotional distress, loss of self-esteem and other injuries. The plaintiff holds GB Instruments Inc. responsible because the defendant allegedly failed to compensate him a rate of time-and-one-half of his regular rate for each hour worked in excess of 40 hours per work week, failed to maintain actual time records, required him to work and overstay in Russia without proper documentations and terminated his employment.

The plaintiff requests a trial by jury and seeks compensation for damages, punitive damages, reinstatement or front pay, emotional distress, attorneys’ fees and costs and such other and further relief as the court may deem proper.
