MIAMI – A Broward County man has filed suit against his insurance company alleging he is entitled to disability benefits.
Ralph Sanders filed a complaint on April 21 in the U.S. District Court for the Southern District of Florida against Sun Life Assurance Co. of Canada citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff originally filed for long-term disability benefits in March 2014, which was denied by the defendant. The suit states the plaintiff appealed and was granted disability benefits in January 2015 by the defendant, only to deny them again in May. The plaintiff holds Sun Life Assurance Co. of Canada responsible because the defendant allegedly denied his claim in whole or in part, failed to properly and adequately investigate the merits of his disability claim and failed to provide a full and fair review of his claim.
The plaintiff requests a trial by jury and seeks declaration that he is entitled to immediate reinstatement to the long-term disability plan, payment of disability benefits due, attorney’s fees and costs, prejudgment and post-judgment interest and such other and further relief as the court may deem just and proper. He is represented by Stephen F. Jessup of Attorneys Dell & Schaefer Chartered in Hollywood.
