FORT MYERS – A Lee County accessory manufacturer is suing a Nevada business alleging it infringed a patent for a concealed carry handbag.

Divine Purse Co. LLC, doing business as Packin' Neat, filed a complaint on April 20 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Shepax Inc. citing patent infringement.

According to the complaint, the plaintiff alleges that due to defendant's infringing activities, it has been damaged and will continue to be damaged until a decision is made in its favor. The plaintiff holds Shepax Inc. responsible because the defendant allegedly directly infringed its '391 B1 Patent, which regards a purse and handbag organizer with a built-in firearm holster, and falsely marked and marketed its product as patent protected.

The plaintiff requests a trial by jury and seeks declaration that defendant has infringed the plaintiff's Patent No. 9,265,319 B1, compensation for all damages, attorney's fees and costs and such other and further relief as the court may deem just and proper. It is represented by Kevin L. Dees of Schaps & Dees PA in Tampa.
