Miami-Dade County resident accuses Pancito of unpaid wages

MIAMI – A former cook alleges that a Miami-Dade County restaurant did not properly pay him for all hours worked.

Larry Rey filed a complaint on April 11 in the U.S. District Court for the Southern District of Florida, Miami Division against Pancito LLC and Alberto A. Cabrera alleging that they violated the Fair Labor Standards Act and the Florida Minimum Wage Act.

According to the complaint, the plaintiff alleges that between August 2014 and September 2015, he worked approximately 50 hours per week but did not receive the hourly rate the defendants had agreed to pay him. He alleges he also wasn't paid time-and-one-half overtime rate for all hours worked in excess of 40 hours per week. The plaintiff holds Pancito LLC and Cabrera responsible because the defendants allegedly breached their oral agreement, failed to pay the appropriate Florida minimum wage and refused to pay overtime compensation.

The plaintiff requests a trial by jury and seeks compensation for unpaid wages, liquidated damages, reasonable attorneys’ fees, costs, interest and for all other proper relief, including interest. He is represented by Diane P. Perez of Diane Perez PA in Coral Gables.
