Consumer accuses Comenity Bank of telephone harassment

TAMPA – A consumer is suing a debt collector alleging that it called her more than 1,000 times using an automatic telephone dialing system.

Sandra Laurentano filed a complaint on April 14 in the Tampa Division of the Middle District of Florida against Comenity LLC, doing business as Comenity Bank, alleging that the debt collector violated the Telephone Consumer Protection Act and the Florida Collection Practices Act.

According to the complaint, the plaintiff alleges that,since 2014, she has received approximately 1,000 calls to her cellular telephone without her prior express permission from the defendant. The plaintiff holds Comenity Bank responsible because the defendant allegedly intentionally harassed and abused her by calling several times on one day and on back-to-back days, made calls using an automatic telephone dialing system and/or pre-recorded or artificial voice and continued its campaign to call despite her repeated requests to stop calling her.

The plaintiff requests a trial by jury and seeks compensation for actual, statutory and punitive damages, attorneys' fees and costs and for all other and further relief that the court may deem just and proper.
