Woman alleges Summerlin Crossing restricts access to the disabled

ORLANDO – A disabled person is suing the owners of Summerlin Crossing over allegations that the facility operator discriminated against her by denying her access safe, full and equal enjoyment of the goods, services offered at the facility.

Patricia Kennedy filed a complaint on April 13 in the U.S. District Court for the Middle District of Florida against Prisa Summerlin FL LLC alleging failure to uphold Americans with Disabilities Act regulations.

According to the complaint, the plaintiff alleges that she has suffered and continues to suffer direct and indirect injury, frustration and humiliation as the result of the discriminatory conditions present at the facility. The plaintiff holds Prisa Summerlin FL LLC responsible because the defendant allegedly failed to provide an accessible route connecting the disabled parking spaces with the facilities of the property, failed to provide compliant restrooms and created hazards to her safety.

The plaintiff requests a trial by jury and seeks judgment that determines that the defendant violated the ADA, an order to make such facility readily accessible to and usable by individuals with disabilities, an order requiring defendant to make reasonable modifications in policies and procedures, necessary to accommodate disabled persons, attorney’s fees, costs and expenses and for such other relief as the court may deem just and proper.
