Consumer accuses Regional Acceptance Corp. of invasion of privacy

MIAMI – A Collier County man alleges a debt collector has repeatedly contacted him in an attempt to reach an unknown party.

Jean Senatus filed a complaint on April 10 in the U.S. District Court for the Southern District of Florida against Regional Acceptance Corp. alleging that the debt collector violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that he has received no less than 200 unwanted calls to his cellular telephone from the defendant. He alleges he has been substantially damaged and charged for the defendant's calls. The plaintiff holds Regional Acceptance Corp. responsible because the defendant allegedly habitually called him using an automatic telephone dialing system and/or pre-recorded or artificial voice despite being told to stop calling him and that he was not the person it was trying to contact.

The plaintiff requests a trial by jury and seeks an injunction requiring defendant to cease calling him; compensation for actual, treble, punitive and statutory damages; reasonable attorneys’ fees and costs; and for such other and further relief that the court may deem reasonable and just.
