Former employee alleges he was wrongfully terminated by Stewart Title Co.

MIAMI – A business development officer is suing his former employer over allegations he was wrongfully terminated because of his age.

Mark Finkelstein filed a complaint on April 8 in the U.S. District Court for the Southern District of Florida against Stewart Title Co. alleging that the former employer violated the Age Discrimination in Employment Act and the Florida Civil Rights Act.

According to the complaint, the plaintiff, 56, alleges that on April 9, 2014, he received an email from his supervisor Laurie Cooper congratulating him for doing a great job in sales and on April 10, 2014, he was informed by Cooper that he was terminated. After a discussion, he was allowed to remain for the rest of the quarter with a reduction in pay, the suit states. The plaintiff holds Stewart Title Co. responsible because the defendant allegedly hired a younger female to replace him and constructively terminated him after reducing his compensation by 66 percent. He alleges he has been unable to find work at the same rate of pay.

The plaintiff requests a trial by jury and seeks compensation for damages totaling no less than $250,000, reasonable attorney’s fees and costs and any other relief that the court may deem appropriate. He is represented by Warren Q. Peebles of Thomas and Pearl PA in Fort Lauderdale.
