Man alleges Jetty Lounge is not ADA compliant

MIAMI – A disabled man has filed suit against the property owner and owner of the Jetty Lounge over claims it is not accessible to those with mobility issues.

David Poschmann filed a complaint on April 8 in the U.S. District Court for the Southern District of Florida against Reajac Inc. and Fort Pierce Jetty LLC, alleging that the defendants' Jetty Lounge violates the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he was denied full and equal enjoyment of the goods, services, facilities, privileges, advantages and accommodations offered at the property when he visited on Oct. 5, 2015. The plaintiff holds Reajac Inc. and Fort Pierce Jetty LLC responsible because the defendants allegedly failed to provide exterior accessible routes, failed to provide an accessible parking aisle, failed to provide accessible signage and failed to provide a dining room and restrooms accessible to and usable by persons with disabilities.

The plaintiff requests a trial by jury and seeks a permanent injunction enjoining defendants from continuing their mobility-related discriminatory practices, an order against defendant to implement policies to accommodate individual with disabilities, reasonable attorney’s fees, litigation expenses, expert fees and costs.
