Former employee alleges Roy Mizell & Kurtz Funeral Home did not pay overtime

MIAMI – An assistant to the director has filed suit against a funeral home alleging he was not paid overtime wages.

Quenton Thompkins filed a complaint on April 8 in the U.S. District Court for the Southern District of Florida against Roy Mizell & Kurtz Funeral Home and Richard Kurtz alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between 1994 and June 30, 2015, he did not receive overtime wages. The plaintiff holds Roy Mizell & Kurtz Funeral Home and Richard Kurtz responsible because the defendants allegedly failed to compensate him at a rate of time-and-one-half of his hourly rate for all hours worked in excess of 40 in a work week and retaliated against him for complaining about the defendants' purportedly unlawful pay practices.

The plaintiff requests a trial by jury and seeks compensation for unpaid overtime wages, liquidated and punitive damages, attorney's fees and costs. He is represented by Todd W. Shulby of Todd W. Shulby PA in Weston.
