Server alleges Papa Vito's Italian Restaurant did not properly pay employees

ORLANDO – A former server alleges a Brevard County restaurant did not pay its employees overtime wages.

Shelby Sanchez filed a complaint on behalf of those similarly situated on April 7 in the U.S. District Court for the Middle District of Florida, Orlando Division against Grundy Pizza Inc., doing business as Papa Vito's Italian Restaurant, and William Graham alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between August 2015 and January, she did not receive proper overtime pay for all hours worked in excess of 40 in a work week. She also alleges that she was not paid minimum wage for all hours worked during one or more weeks. The plaintiff holds Papa Vito's Italian Restaurant and Graham responsible because the defendants allegedly failed to compensate her at a rate of time-and-one-half of her hourly rate for all extra hours performed and has a practice of altering employees recorded hours to avoid paying overtime wages.

The plaintiff requests a trial by jury and seeks compensation for unpaid wages, an additional and equal amount of liquidated damages, attorney's fees and costs, declaratory relief and any further relief that the court may find just and appropriate. She is represented by Matthew R. Gunter of Morgan & Morgan PA in Orlando.
