Former radio employee alleges age discrimination

Wrongful term 14

MIAMI – The former general sales manager for WKIS-FM alleges she was wrongfully terminated because of her age.

Margaret Carole Bowen, 59, filed a complaint on April 6 in the U.S. District Court for the Southern District of Florida, Miami Division against CBS Radio alleging violation of the Age Discrimination in Employment Act and the Florida Civil Rights Act.

According to the complaint, CBS acquired WKIS-FM in December 2014. The plaintiff holds CBS Radio responsible because the defendant allegedly reduced her base salary and bonus opportunities after the acquisition of WKIS-FM and fired her on Aug. 24, 2015, allegedly as a result of restructuring. She alleges the defendant has exhibited a pattern of eliminating older managers and replacing them with younger individuals who are less qualified, and/or not being given other opportunities in the organization compared to their younger counterparts.

The plaintiff requests a trial by jury and seeks declaratory judgment that the defendant’s discriminatory practices toward her are violations of her rights under the ADEA, permanently restraining defendant from violating the rights of employees, an order for her reinstatement, compensation for all damages, prejudgment interest, costs and a reasonable attorney’s fees and for any other relief as the court may deem necessary and proper. She is represented by Erika Deutsch Rotbart of Deutsch Rotbart & Associates PA in Boca Raton.
