Broward County resident accuses Orange Tree Restaurant of not complying with ADA

MIAMI – A man alleges that a Tamarac restaurant contains architectural barriers that restrict access to the disabled.

Julius Seiler filed a complaint on April 1 in the U.S. District Court for the Southern District of Florida against Orange Tree Breakfast & Lunch Inc., doing business as Orange Tree Restaurant, alleging that the property owner failed to comply with the Americans with Disabilities Act Accessibility Guidelines.

According to the complaint, the plaintiff alleges that on March 26, he encountered barriers to access the defendant's facility and was denied full, easy, safe and equal access to the facilities, goods, services and amenities. The plaintiff holds Orange Tree Restaurant responsible because the defendant allegedly failed to remove barriers in the restroom, failed to provide proper signage for an accessible restroom or failed to redirect a disabled person to the closest available accessible restroom, among other related issues.

The plaintiff requests a trial by jury and seeks an order requiring defendants to alter its facilities to make it accessible to and usable by individuals with disabilities, reasonable attorney's fees and costs, and any further relief as the court may deem necessary, just and proper.
