Midland Credit Management Inc. accused of repeatedly calling wrong person to collect debt

FORT LAUDERDALE – A man is suing a debt collector over allegations it has repeatedly called him in an attempt to reach an unknown third party.

Stephen Dambra filed a complaint on April 5 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Midland Credit Management Inc. alleging that the debt collector violated the Fair Debt Collection Practices Act provisions.

According to the complaint, the plaintiff alleges that the defendant made calls in connection with the collection of an alleged debt that belongs to another person in August 2015. The plaintiff holds Midland Credit Management Inc. responsible because he continued to receive non-emergency telephone calls from the defendant even after he demanded it to cease calling him.

The plaintiff requests a trial by jury and seeks compensation for actual and statutory damages, reasonable attorneys’ fees and costs, prejudgment and post-judgment interest and for such other and further relief as the court may deem just and proper.
