Consumer alleges collector did not remove disputed debt from credit report

ORLANDO – A Mims woman alleges a Tampa debt collector engaged in misleading and unfair debt collection practices.

Beverly Box, also known as Beverly Lockhart, filed a complaint on March 28 in the U.S. District Court for the Middle District of Florida against Preferred Collection and Management Services Inc. alleging that the debt collector violated the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff states she disputed a debt directly with the defendant in December 2015. She holds Preferred Collection and Management Services Inc. responsible because the defendant allegedly reported the alleged debt on her credit report and had not removed the credit account nor marked it as disputed by customer, which is a violation of the FDCPA.

The plaintiff requests a trial by jury and seeks compensation for actual and statutory damages, attorney's fees and costs and for such other relief as the court may deem just and proper. She is represented by Michael J. Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
