Former employees allege Accounting Fulfillment Services did not pay overtime wages

TAMPA – Sales representatives and team managers have filed a class-action lawsuit against their former employers alleging unpaid wages.

Michael Berger, Jacob Bullock, Ryan Carroll, Anthony Alarcon, David Emery and Courtney Polivka filed a complaint on behalf of themselves and all those similarly situated on March 28 in the Tampa Division of the Middle District of Florida against Accounting Fulfillment Services LLC, Manhattan Professional Group Inc., Michael Savage, Brendan Pack, Gary Melwick and Lindsey Kush, alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they did not receive any payment for all hours they worked in excess of 40 in a single week. The plaintiffs hold the defendants responsible because the defendants allegedly failed to properly compensate them at time-and-one-half of their regular rate for all their overtime hours. 

The plaintiffs request a trial by jury and seek compensation for damages in the amount of unpaid overtime compensation, an equal amount of liquidated damages, reasonable attorneys' fees and costs, prejudgment and post-judgment interest and any additional relief as the court may deem just and proper. They are represented by Ryan D. Barack and Michelle Erin Nadeau of Kwall, Showers, Barack & Chilson PA in Clearwater.
