Man alleges Nueva San Salvador Restaurant not accessible to disabled patrons

MIAMI – A Miami man alleges a restaurant in the city has barriers that restrict access to the disabled.

Christopher Hansen filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida against Nueva San Salvador Restaurant No. 3 Corp. and J P Investments LLC alleging that they violated the Americans with Disabilities Act Accessibility Guidelines and the Florida building code.

According to the complaint, the plaintiff alleges that he was denied full and equal enjoyment of the goods, services advantages, and/or accommodations offered at the defendants' facility. The plaintiff holds Nueva San Salvador Restaurant No. 3 Corp. and J P Investments LLC responsible because the defendants allegedly have discriminated against him by denying safe and full access to their facility, failed to have an accessible ramp leading the entrance, failed to provide an accessible parking area and failed to provide dining area and restrooms accessible to individuals with disabilities.

The plaintiff requests a trial by jury and seeks a permanent injunction enjoining the defendants from continuing their discriminatory practices, an order for defendants to remove the physical barriers and to alter the subject facility to make it readily accessible to and useable by individuals with disabilities, reasonable attorney’s fees, costs and litigation expenses.
