Marion County resident accuses Tires 4 Less Auto Repair Inc. of unpaid wages

Law money 12

OCALA – A garage worker has filed a class-action lawsuit against an auto repair shop over allegations he wasn't paid overtime wages.

Thomas Rice Jr. filed a complaint on behalf of himself and those similarly situated on March 28 in the U.S. District Court for the Middle District of Florida, Ocala Division against Tires 4 Less Auto Repair Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that throughout his employment he did not receive any additional payment for all hours he worked in excess of 40 in a work week. The plaintiff holds Tires 4 Less Auto Repair Inc. responsible because the defendant allegedly failed to compensate him at time-and-one-half of his hourly rate.

The plaintiff requests a trial by jury and seeks compensation for liquidated and nominal damages, prejudgment and post-judgment interest, attorney's fees and costs and any further relief that the court may deem just and proper. He is represented by Matthew W. Birk of The Law Office of Matthew Birk LLC in Gainesville.
