FORT MYERS – A disabled Lee County man alleges his disability payments were terminated after he refused a settlement from his insurance company.

George T. Goros filed a complaint on March 25, in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Sun Life Insurance Co. of Canada alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he was approved for long-term disability benefits in 2012. The suit states that the defendant offered $202,351.80 to settle his disability claim, which he refused, and the defendant terminated his benefits in 2014 over claims he was no longer totally disabled.

The plaintiff holds Sun Life Insurance Company of Canada responsible because the defendant allegedly relied on the opinions of its physician to determine benefits without a physical examination of the plaintiff.

The plaintiff requests a trial by jury and seeks compensation for unpaid benefits and waiver of insurance premium, plus interest and reinstatement of these benefits, attorneys' fees and costs and for any further relief that the court may deem just and proper. He is represented by Carol Avard, Douglas D. Mohney and Mark Zakhvatayev of Avard Law Office in Cape Coral.
