FORT LAUDERDALE – A Broward County woman is suing the property owners of Neapolitan Plaza in Naples, alleging that it has barriers that restrict access to the disabled.
Patricia Kennedy filed a complaint on March 24 in the U.S. District Court for the Middle District of Florida against CH Realty IV/ R Naples Neapolitan LLC, alleging violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that she suffered irreparable harm and was denied equal enjoyment of the goods and services offered at the property. The plaintiff holds CH Realty IV/ R Naples Neapolitan LLC responsible because the defendant allegedly failed to have an accessible facility for persons with disabilities and failed to make reasonable modifications in its policies to provide full and equal enjoyment to disabled individuals.
The plaintiff requests a trial by jury and seeks an order to make the facility readily accessible to and usable by individuals with disabilities, an order to make reasonable modifications in the defendant's policies to accommodate persons with disabilities, attorney’s fees, costs and any other relief as the court may deem just and proper.
