Miami-Dade County resident accuses Waste Management Inc. of Florida of unpaid overtime wages

MIAMI – A truck driver is suing his former employer over allegations he was not paid overtime.

Kerne Cher-Enfant filed a complaint on March 24 in the U.S. District Court for the Southern District of Florida, Miami Division against Waste Management Inc. of Florida, alleging that the former employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he did not receive proper overtime compensation for all hours worked in excess of 40 in a week during his employment. The plaintiff holds Waste Management Inc. of Florida responsible because the defendant allegedly failed to properly compensate him for all extra hours that he worked at time-and-one-half of his hourly rate. The defendant also allegedly fabricated pay stubs, which purportedly show that it paid the plaintiff regular time and overtime.

The plaintiff requests a trial by jury and seeks compensation damages in the amount of $70,272, an equal amount in double damages/liquidated damages, reasonable attorney’s fees and costs and any further relief as the court may deem equitable and just.
