Former kitchen cook accuses South Beach Diner Inc. of unpaid wages

MIAMI – A Miami-Dade County resident is suing is his former employers alleging he wasn't paid overtime.

Oscar Alvarado filed a complaint on March 25 in the U.S. District Court for the Southern District of Florida, Miami Division against the South Beach Diner Inc., Raymond Schnitzer and Howard Sanders, alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between December 2010 and October 2013, he was not paid proper overtime premium for all hours he worked in excess of 40 in a work week. The plaintiff holds South Beach Diner Inc., Schnitzer and Sanders responsible because the defendants allegedly failed to compensate his overtime hours at the statutory rate of time-and-one-half of his hourly rate. The defendant allegedly attempted to circumvent the provisions of the law by paying his extra hours as a bonus.

The plaintiff requests a trial by jury and seeks compensation for liquidated damages, reasonable attorney’s fees and costs, prejudgment interest and any further relief which the court may deem reasonable under the circumstances.
