Sumter County resident accuses Educational Credit Management Corp. of telephone harassment

OCALA – An Oxford man consumer is suing a collection agency alleging violation of telephone harassment statutes in an attempt to collect a purported student loan debt.

Craig Hembach filed a complaint on March 22 in the U.S. District Court for the Middle District of Florida, Ocala Division against Educational Credit Management Corp., alleging that the collection agency violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he continued to receive numerous unwanted telephone calls from the defendant without his prior express consent, even after his attorney's office mailed three cease and desist requests to stop further communications with him and his wife. The plaintiff holds Educational Credit Management Corp. responsible because the defendant allegedly placed non-emergency calls using an automated telephone dialing system and/or pre-recorded or artificial voice messages.

The plaintiff requests a trial by jury and seeks an injunctive relief prohibiting such conduct in the future, compensation for statutory and treble damages and any further relief that the court may deem just and appropriate.
