MIAMI – A British Virgin Islands corporation is suing a Miami Beach yacht dealer alleging that it misrepresented that additional upgrades were not included in the original purchase price of a yacht.

Hyded Trading Corp. filed a complaint on March 16 in the U.S. District Court for the Southern District of Florida against YachtBrasil Motor Boats and Charters LLC, citing fraud, negligent misrepresentation and other counts.

According to the complaint, the plaintiff alleges that it purchased a yacht from the defendant and that the purchase price included two spare five-blade propellers and one spare shaft. The suit states that the defendant later fraudulently invoiced an additional $44,692 for the spare parts. The suit also states there was an issue with the warranty and other items.

The plaintiff seeks the following: compensation for all damages plus interest; post-judgment interest; attorneys’ fees, costs and; and any further relief as the court may deem just and proper. It is represented by Christopher R. Fertig of Fertig and Gramling in Fort Lauderdale.
