Man alleges he was terminated for taking leave for medical treatment

ORLANDO – A Kissimmee man alleges he was terminated by a restaurant in Disney's Animal Kingdom theme park because he took time off for treatment for a back injury.

Luis E. Perez filed a complaint on March 16, in the U.S. District Court for the Middle District of Florida, Orlando Division against T-Rex Cafe-Orlando Inc., alleging that the restaurant operator violated the Family and Medical Leave Act and the Florida Civil Rights Act regulations.

According to the complaint, the plaintiff alleges that he was denied reasonable accommodation to have medical treatment for back pain and was terminated from work after he failed to find someone to cover his shift. The plaintiff holds T-Rex Cafe-Orlando Inc. responsible because the defendant allegedly failed to apprise him of his rights under the FMLA and failed to restore him to his former position after missing work to visit his doctor.

The plaintiff seeks the following: compensation for all damages; prejudgment and post-judgment interest; reinstatement; reasonable attorneys' fees and costs; and any further relief that the court may deem just and proper. He is represented by Daniel A. Perez of Hogan & Hogan PA in Orlando.
