Man alleges Wells Fargo has harassed him with numerous phone calls

OCALA – A Lake County man alleges that a bank has harassed him through repeated telephone calls trying to reach an individual he doesn't know.

Michael Smith filed a complaint on March 17 in the U.S. District Court for the Middle District of Florida, Ocala Division against Wells Fargo Bank, doing business as Wells Fargo Dealers Services Inc., citing violation of Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that he received several telephone calls in an attempt to collect a consumer debt that belongs to an individual he doesn't know. The plaintiff holds Wells Fargo Dealers Services Inc. responsible because the defendant allegedly made approximately 1,000 times calls using an automated telephone dialing system and/or a pre-recorded or artificial voice messages, which is in violation of the TCPA, despite requests to representatives to stop calling.

The plaintiff seeks the following: compensation for all damages, attorneys' fees and costs, and any further relief that the court may deem just and proper. He is represented by Octavio "Tav" Gomez of Morgan & Morgan, Tampa in Tampa.
