Prudential accused of denying disability benefits

TAMPA – An insurance company is facing a lawsuit alleging that it denied a woman long-term disability benefits.

Linda Progar filed a complaint on March 11 in the Tampa Division of the Middle District of Florida against The Prudential Insurance Co. of America, alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has not received her benefits under the long-term disability plan. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly subjected her to an unreasonable claims process, refused to pay her benefits in pursuant to the insurance policy and failed to comply with the provisions of the plan.

The plaintiff seeks the following: a declaration that she is entitled to reinstatement to the benefits; attorneys' fees, costs and interest; and any further relief that the court may deem appropriate. She is represented by William S. Coffman Jr. of Coffman Law in Tampa.
