Hair extension retailer sues competitor over Instagram post

MIAMI — A hair extension retails is suing another hair extension retailer, claiming an Instagram post by the defendant was false; that it could or did deceive consumers; that it was libelous, deceptive and misleading; and that it constituted tortious interference.

Hair Are Us Inc. is suing Her Imports LLC, a competitor, claiming violation of the Lanham Act and the Florida Deceptive and Unfair Trade Practices Act.

Hair Are Us filed suit on March 9 in U.S. District Court for the Southern District of Florida, alleging that the plaintiff suffered loss of goodwill, loss of customers and loss of profits because the defendant allegedly maliciously posted false and misleading statements about the plaintiff's business on Instagram.

The plaintiff seeks injunctive relief prohibiting defendant from engaging in false or misleading advertising, compensation for damages and for profits obtained by the defendant, attorneys’ fees and costs, pre-judgment and post-judgment interest and any further relief that the court may deem just and proper. It is represented by Harry Tapias, Camilo Espinosa and Kaustubh Nadkarni of Loigica, P.A. in Miami Beach.
