Company sues farm operators over alleged breach of contract

FORT MYERS – A seed and crop protection producer is suing farm operators over allegedly unpaid delivered goods.

Winfield Solutions LLC filed a complaint on March 8 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Cecil R. Howell Jr. and Box Eleven Ranch LLC, citing breach of contract.

According to the complaint, the plaintiff alleges that it has incurred and will continue in the future to incur damages until a decision is rendered in its favor. The plaintiff holds Howell Jr. and Box Eleven Ranch LLC responsible because the defendants allegedly failed to pay for certain products they ordered and received from the plaintiff from August through December 2015.

The plaintiff seeks the following: recovery of the purchase price of $156,187.86, plus late charges, attorney fees and costs and any further relief as the court may deem just and equitable. It is represented by Jon Marshall Oden of Ball Janik LLP in Orlando.
