MIAMI – A personal trainer is suing a fitness center over allegations of unpaid overtime.
Jonathan Valentin filed a complaint on March 8 in the U.S. District Court for the Southern District of Florida against 24 Hour Fitness USA Inc., citing violations of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he has not received overtime compensation for all hours worked in excess of the 40-hour work week. The plaintiff holds 24 Hour Fitness USA Inc. responsible because the defendant allegedly required him to work off the clock, failed to properly maintain daily time records and refused to pay his overtime wages in the course of his employment. He alleges that he has estimated that he is owed $28,267.20 in unpaid wages.
The plaintiff seeks the following: liquidated damages, attorney’s fees and costs and any further relief as may be allowed by law. He is represented by Roderick V. Hannah in Plantation and Pelayo M. Duran of the Law Office of Pelayo Duran PA in Miami.
