Motorcycle rider alleges semi driver struck, ran over him

MIAMI – A motorcycle rider is suing the driver of a tractor-trailer over alleged injuries after an accident in Miami-Dade County.

Edwin E. Leslie filed a complaint on March 8 in the U.S. District Court for the Southern District of Florida against Charlie C. Lumpkin and Southern AG Carriers Inc., citing negligence and vicarious liability.

According to the complaint, the plaintiff alleges that on Dec. 3, 2014, he was at a complete stop at the intersection of Northwest 20th Street and Northwest 12th Avenue when he was hit by a tractor-trailer driven by Lumpkin and owned by Southern AG Carriers. The suit states that Lumpkin drove over Leslie and dragged his body down the street before realizing he had struck the plaintiff. The plaintiff holds Lumpkin and Southern AG Carriers Inc. responsible because the Lumpkin allegedly failed to exercise reasonable care in operating the vehicle.

The plaintiff seeks compensation for all damages. He is represented by T. Omar Malone of The Malone Law Firm PA in Miami.
