Former employee sues Abercrombie for allegedly unpaid wages

FORT LAUDERDALE – A Broward County woman is suing a retail chain over allegations she was improperly paid.

Shayla Ellis filed a complaint on March 7 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Abercrombie & Fitch Stores Inc. alleging that the former employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between October 2011 and Dec. 9, 2015, she suffered damages and lost compensation for time worked more than 40 hours per week. The plaintiff holds Abercrombie & Fitch Stores Inc. responsible because the defendant allegedly refused to properly compensation her at a rate of time-and-one-half of her regular rate for all hours worked more than 40 hours in a single week, failed to maintain proper time records and failed to apprise her of her rights under the FLSA.

The plaintiff seeks the following: compensation for liquidated damages, reasonable attorneys' fees and costs, prejudgment interest and any further relief that the court may deem just and proper. She is represented by Richard Celler of Richard Celler Legal PA in Davie.
