Joe Cool Air Conditioning & Heating of the Suncoast Inc. accused of not paying wages

TAMPA – A former operations manager is suing his ex-employer over allegations of unpaid wages.

John E. Welch Jr. filed a complaint on March 4 in the Tampa Division of the Middle District of Florida against Joe Cool Air Conditioning & Heating of the Suncoast Inc. and Thomas M. Graham, citing violation of the Fair Labor Standards Act and Florida state law.

According to the complaint, the plaintiff alleges that he suffered damages by being denied overtime wages and commissions. The plaintiff holds Joe Cool Air Conditioning & Heating of the Suncoast Inc. and Thomas M. Graham responsible because the defendants allegedly refused to pay his overtime wages at a rate of time-and-one-half his regular rate of pay for all hours worked in excess of 40 hours and failed to pay him 1 percent of the gross sales from the commercial division in accordance with their agreement.

The plaintiff seeks the following: back pay, prejudgment interest, reasonable attorney’s fees and costs and any further relief that the court may deem just and proper. He is represented by Dennis A. Creed III and Joseph Odato of Feldman Law Group PA in Tampa.
