MIAMI — An Illinois woman is suing a cruise ship line, claiming she was injured due to negligence.
Mardolyn Vescovi sued Carnival Corporation on March 3 in U.S. District Court for the Southern District of Florida Miami Division, citing negligence and breach of duty of care while she was aboard the cruise ship Miracle.
The plaintiff alleges that, on Jan. 18, 2015, she was struck from behind by a poker machine that was being moved by a crew member. The plaintiff holds Carnival Corporation responsible because the defendant's crew member allegedly failed to properly secure the poker machine to the cart while being transported, allegedly failed to have an assistant to prevent the poker machine from falling off, and allegedly moved the machine at a time when it had to be maneuvered around passengers in the casino.
The plaintiff seeks compensation for all damages allowable by law, prejudgment interest, costs and any further relief that the court may deem just and appropriate. She is represented by Joel M. Barnett of Waks & Barnett, P.A. in Miami.
