JACKSONVILLE — A company that says it sells "high quality e-liquids" is suing another e-liquid company and a California-based website, claiming trademark infringement.
Spectrum Vapor Sao LLC sued competitors Savage E-Liquid Corp. and www.vapeshopsupply.com on March 1 in U.S. District Court for the Middle District of Florida Jacksonville Division, and makes allegations including violation of trademark laws including the Lanham Act; false designation of origin; misleading advertising; and deceptive trade practices.
The plaintiff, which sells e-liquids under the Spectrum and Spectrum Vapors marks, claims the defendants sell and market products under the name Spektrum, and allege that consumer confusion is exacerbated by a link to the plaintiff's website on a competing social media page at www.facebook.com/Spektrumvapors.
The plaintiff seeks the following: an order to stop using the Spektrum mark and to remove the Spektrum mark or any other name, mark or symbol likely to cause confusion with plaintiff's Spectrum marks; compensation for damages; attorneys' fees and costs; and any further relief that the court may seem just and proper.
