LA Fitness accused of violating TCPA

MIAMI – A consumer is suing health and fitness club over allegations of violating consumer protection laws.

Joseph Agostino filed a complaint on March 1 in the U.S. District Court for the Southern District of Florida against Fitness International, doing business as LA Fitness, citing violations of the Florida Consumer Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he has received numerous non-emergency telephone calls in an attempt to collect a debt without his prior express consent from the defendant. The plaintiff holds LA Fitness responsible because the defendant allegedly made calls through the use of an automatic telephone dialing system.

The plaintiff seeks the following: compensation for statutory, punitive and treble damages, attorney’s fees and costs and any further relief that the court may deem just and proper. He is represented by Clayton T. Kuhn of Kuhn Legal PA in Hollywood.
