Former salesperson sues Point 180 over alleged disability discrimination

Employeetermination

ORLANDO – An Osceola County man is suing his former employer over allegations of wrongful termination because of his disability.

Fernando E. Morales filed a complaint on March 1 in the U.S. District Court for the Middle District of Florida, Orlando Division against Point 180 LLC, alleging that the company violated the American with Disabilities Act and the Florida Civil Rights Act.

According to the complaint, the plaintiff alleges that he suffers from ataxia, which affects movement and speech. He alleges he suffered mental anguish, loss of dignity and other intangible injuries because the defendant terminated him from work in 2014 because his manager believed he was suffering from alcoholism and was drunk at work, and these accusations are false.

The plaintiff seeks the following: an injunction prohibiting defendant from further violation of ADA-AA and FCRA; compensation for back pay and front pay, plus benefits, punitive damages, prejudgment and post-judgment interest; and any further relief that the court may deem just and proper. He is represented by Daniel E. Perez of Hogan & Hogan PA in Orlando.
