JACKSONVILLE – A former community development specialist at Microsoft Corp. alleges her insurance company wrongfully denied her long-term disability benefits.

Melanie Davis filed a complaint on Feb. 29 in the U.S. District Court for the Middle District of Florida, Jacksonville Division, citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has not been able to work since November 2013 because of various medical conditions. She alleges she applied for long-term disability benefits but was denied by the defendant in December 2014. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly breached its fiduciary duties, ignored her medical records and relied on the views of its medical consultants.

The plaintiff seeks the following: compensation for unpaid benefits, interest, attorney's fees and costs and any other relief that the court may deem just and proper. She is represented by Carter Meader and Edward P. Dabdoub of Wagar Dabdoub PA in Coral Gables.
