Man sues retailer over allegations of unwanted texts

JACKSONVILLE — A St. Johns County man is suing a sporting goods retailer, claiming the company sent him dozens of unwanted text messages via an auto-dialer, despite at least five requests for the texts to stop.

Martin Foster is suing Texas-baased Academy Ltd., doing business as Academy Sports & Outdoors, a sporting goods retailer, claiming violation of the federal Telephone Consumer Protection Act.

Foster sued on Feb. 29 in U.S. District Court for the Middle District of Florida Jacksonville Division, claiming Academy Sports & Outdoors allegedly sent several text messages without his prior express consent and continued to text him even after he sent a stop notice.

The plaintiff seeks the following: compensation for statutory, treble and punitive damages,and any further relief that the court may deem just and proper. He is represented by Frank H. Kerney III of Morgan & Morgan, Tampa, P.A. in Tampa.
