Former legal secretary sues law firm for allegedly unpaid wages

MIAMI – A legal secretary is suing her former employer alleging she was never paid overtime wages.

Ana Bacallao filed a complaint on Feb. 26 in the U.S. District Court for the Southern District of Florida against J.H. Zidell, P.A. and Jaime H. Zidell, alleging that they intentionally violated the Fair Labor Standards Act by improperly classifying her as an independent contractor.

According to the complaint, the plaintiff alleges that, between May 29, 2015, and Jan. 18, 2016, she never received payment for her extra hours worked over 40 hours per week. The plaintiff holds the defendants responsible because they allegedly refused to pay her overtime compensation as required by law and failed to properly disclose or apprise her rights under the FLSA.

The plaintiff seeks the following: compensation for overtime wages due, liquidated damages, reasonable attorney’s fees and costs, post-judgment interest and any further relief that the court may deem just and proper. She is represented by Pavel Kogan of Kogan Prober PA in Fort Lauderdale.
