A consumer is suing collection servicing firm for alleged invasion of privacy

FORT MYERS — A Florida woman is suing a North Carolina debt collector, claiming the defendant "harassed and abused" the plaintiff by calling her cell phone repeatedly and using an automated dialing system without her prior express consent, and also claiming that the debt was owed by an unknown third party.

Sanjuana Garza is suing PMAB LLC, a collection servicing firm, citing alleged invasion of privacy and violation of telephone harassment statutes.

Garza filed a complaint on Feb. 25 in U.S. District Court for the Middle District of Florida Fort Myers Division against PMAB LLC alleging that the collection servicing firm willfully violated the Telephone Consumer Protection Act by attempting to collect a debt that belongs to an unknown third party.

The plaintiff seeks the following: compensation for statutory, punitive, actual and treble damages, costs for this action, interest and any other relief that the court may deem just and proper. She is represented by Frank H. Kerney III of Morgan & Morgan, Tampa, P.A. in Tampa.
