Insurer claims pump failure caused costly flooding

ORLANDO — A Pennsylvania-based insurance company is suing a Kentucky pump manufacturer, claiming failed pumps resulted in expensive flooding of an Orlando hospital during construction.

Ace American Insurance Company sued Zoeller Company, a pump manufacturer, citing alleged breach of duty, manufacturing defect and negligence.

The insurance company sued on Feb. 16 in U.S. District Court for the Middle District of Florida Orlando Division, alleging that Zoeller manufactured pumps with defective seals.

The plaintiff alleges that it provided a builder's risk insurance policy, and that flooding caused by the defective Zoeller pumps on Feb. 18, 2014, meant the insurance company had to indemnify the builder for damages in the amount of $442,969. The plaintiff holds Zoeller Company responsible because the defendant allegedly failed to warn installers of the pump's susceptibility to water leakage, among other allegations.

The plaintiff seeks the following: compensation for an amount not less than $442,969, plus interest, cost and expenses; an order to oblige defendant to answer this complaint; and any further relief allowed by law. The plaintiff is represented by Joshua R. Goodman of Cozen O'Connor in Miami.
