Former store manager sues ex-employer alleging violation of ADA

FORT MYERS – A former store manager alleges she was terminated because of her perceived disability.

Laura Marchese filed a complaint on Feb. 17 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Dolgencorp LLC, citing violations of the Florida Civil Rights Act and Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that she suffered discrimination and harassment and ultimately was terminated in 2008 because of her perceived disability by the defendant. The plaintiff holds Dolgencorp LLC responsible because the defendant allegedly failed to accommodate her.

The plaintiff seeks the following: an order requiring her reinstatement or front pay; compensation for punitive damages; attorneys' fees and costs; and any additional relief that the court may deem just. She is represented by Richard Celler of Richard Celler Legal PA in Davie.
