Pest-control, landscape-care company sued over wage claim

FORT MYERS — A former employee is suing a pest-control and landscape-care company, claiming the company failed to pay overtime wages.

Kirby Eckhardt sued Massey Services Inc. on Feb. 16 in U.S. District Court for the Middle District of Florida Fort Myers Division, claiming the defendant intentionally violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that, from May 2012 through December 2015, he did not receive proper overtime compensation. The plaintiff holds Massey Services responsible because the defendant allegedly failed to pay the rate of time and a half for all hours worked in excess of 40 hours per week.

The plaintiff seeks the following: compensation for liquidated damages, attorneys' fees and costs, post-judgment interest and any further relief that the court may deem just and proper. He is represented by Jason L. Gunter of Jason L. Gunter P.A. in Fort Myers.
