Restaurant sued for alleged failure to pay overtime

MIAMI — A mechanic/laborer from Miami-Dade County is suing an Italian restaurant for allegedly violating an overtime-pay law.

Rafiel Concepcion filed a class-action suit against R.E. and F.A. LLC, doing business as Lombardi's, on Feb. 12 in U.S. District Court for the Southern District of Florida, alleging that the restaurant willfully violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he did not receive time and a half of his regular rate of pay for extra hours worked over forty hours in a work week. The plaintiff holds Lombardi's responsible because the defendant allegedly failed to pay proper overtime compensation.

The plaintiff seeks the following: compensation for liquidated damages, pre-judgment interest, attorneys' fees and costs and any further relief that the court may deem just and proper. He is represented by Richard Caldwell of the Law Office of Richard J. Caldwell, P.A. and Navarro Hernandez of Navarro Hernandez, PL, both of Miami.
