UPS accused of violating ERISA

MIAMI – An insurance company is suing an employer over allegations that it failed to process claims.

Gables Insurance Recovery Inc. filed a complaint on Feb. 11 in the U.S. District Court for the Southern District of Florida against United Parcel Services Inc. and Value Options Inc., citing alleged breach of contract and violation of the Employee Retirement Income Security Act of 1974.

According to the complaint, the plaintiff alleges that it is seeking the recovery of more than $70,000 in properly submitted and covered claims for mental health services and related treatments. The defendant has allegedly refused and failed to pay claims. The suit states the services were rendered between Feb. 24, 2014, through July 2, 2014.

The plaintiff seeks the following: compensation for damages, prejudgment and post-judgment interest, statutory interest, attorneys’ fees and costs and any other relief that the court may deem appropriate. It is represented by Robert N. Pelier of Robert N. Pelier PA in Coral Gables.
