Man claims transportation firm owes him overtime pay

ORLANDO — A Hillsborough County man is suing a Seminole County transportation company, claiming the company incorrectly classified him as an independent contractor and owes him money for overtime pay.

Arturo Santana sued Commercial Express Inc. on Feb. 2 in U.S. District Court for the Middle District of Florida, alleging that the transportation company intentionally violated the Fair Labor Standards Act by classifying him as an individual contractor.

The plaintiff alleges that, between May 2015 and October 2015, he did not receive an overtime premium for all hours over 40 per week that he worked for Commercial Express Inc.

The plaintiff seeks the following: compensation for unpaid back wages, pre-judgment interest, attorneys' fees and costs and any further relief that the court may deem just and equitable. He is represented by Luis A. Cabassa of Wenzel Fenton Cabassa, P.A. in Tampa, Florida.
