MIAMI – A machine operator is suing a beverage company over allegations that it failed to pay overtime wages as required by law.
Duvier Betancourt filed a complaint Feb. 9 in the U.S. District Court for the Southern District of Florida against Sunshine Bottling Co. and Carlos R. Blanco, citing violations of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between Dec. 20, 2006, and January 2015, he did not receive the extra half-time rate for any hours worked over 40 hours in a week.
The plaintiff seeks the following: double damages, reasonable attorney's fees and costs and any other relief that the court may find reasonable. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
